TERMS & CONDITIONS OF ONLINE SALE
We aim to continuously to develop and improve our website assisting you the
customer and to continuously review our products and pricing. The website may
involve the following from time to time which may impact upon the service or
functionality of the site:
amend the terms and conditions

- modify or withdraw items from
- add or remove special offers,
promotions or products
We have tried to make your
browsing and order placing as easy and enjoyable as possible, providing you
with the necessary information and guidance. However as colour reproduction
depends on your individual computer or laptop, the monitor may not display a definitive
colour reflection of the goods displayed.
We have tried to make every effort to ensure that we capture the colour of
furniture and swatches as accurately as possible.
All of our quoted prices are inclusive of V.A.T. at the prevailing rate, however
adjustments will have to be made to comply with any change in rates or other
legally imposed charges in respect of V.A.T.
This agreement is a contract for goods and services between us the supplier and
you the consumer. At the time WFS LTD are in receipt of your order and you the
consumer receive the confirmation email, both parties become bound to provide
the goods (by us the supplier) and to pay in full and accept delivery of the
goods (you the consumer).
1. PURCHASES & PAYMENT
It is important that at the time of placing your order via the website that you
ensure all of your order details are correct and they meet your requirements,
as once your order has been received and confirmed by email, it may not be
possible to amend your order.
Please note that if an error is made by WFS LTD no additional costs will be

2. When the required monies are paid in full and is cleared or authorised (as
set out in clause 1(a) above), you will be legally bound to proceed with the
purchase of the goods you have ordered and you will be liable to pay WFS LTD
the balance of any additional monies (the Balance Due figure provided at the
time of placing the order via the electronic checkout) at the time that sum is
due for payment. The time any sum is due for payment is set out in clause 4
below. This clause does not apply to purchases on extended credit.
3. If you do not pay the purchase price or any balance outstanding on the
purchase price at the time it is due, WFS LTD have the right to recover such
price or balance outstanding on the price from you by legal proceedings. For
the avoidance of doubt, this clause applies to sums due under clause 4 and 5
above and applies:
i) even if you cancel your order (subject to the clause headed Cancellations
below) and/ or you do not intend to accept or collect the goods you have
ii) whether or not the property in the goods has passed to you.
If you are unable to take delivery within five working days of the goods
becoming available and they are PAID IN FULL within seven days, we will store
your goods for up to five working days free of charge. Failing that we reserve the right to apply a
daily storage fee thereafter.
CANCELLATIONS & RETURNS and Consumer Protection (Distance Selling)
Under Distance Selling Regulations, your right to cancel this contract ends
seven working days after the day on which you receive the goods.
Should an instance arise where we are unable to supply the goods you have
ordered, you may cancel your agreement without any charge and will be
The terms of this agreement do not affect your statutory rights in connection
with the goods or such rights as you may have under any relevant legislation
(e.g. the Consumer Credit Act 1974) to withdraw or cancel an order without any
obligation to pay.
Should you wish to return your goods, it is your responsibility to take the
necessary care of the goods. You are liable for any loss or damage until,
therefore they must be unused, from within a domestic environment and no abuse
from children, pets or any other source. Failure to take reasonable care may
result in a claim against you. To minimise the risk of any such action, please
retain the original packaging and use when returning the goods where possible.
Must be done in writing, by the purchaser to the store where the order was
placed up to and including seven
working days following WFS LTD taking receipt of your order. WFS LTD will arrange to have
the goods to be collected up to and including the 50 mile radius of the store
for a small collection fee of £75 and will reimburse the price you have paid
for the goods as well as any initial delivery charges. Outside of this radius, you
are responsible for the return of the goods.
Refunds due to cancellation of
contracts under Distance Selling Regulations, will be made within 30 days, by
the same method used for purchase.
N.B. Please note that if you have
specifically request goods to be supplied and manufactured from our upholstery
collection which are all made to order, not taken from stock,
this must be done within seven days of placing your order and you may incur a
cancellation fee due to materials being ordered to meet your order, after this
date unfortunately we cannot accept a cancellation. These goods are made to
order and you have no statutory right to return them unless they have a defect.
Should we agree to cancel your order of goods from these collections, you agree
to pay a standard fee which of a min of 20% of the total order value.
Goods will be delivered within scheduled timeframe at time order was placed,
unless stated otherwise. All dates
quoted at the time of sale are made in good faith and recognised that they are
estimated dates only as matter may be out of our control and include third
parties, whilst we always make every effort to honour them delays can sometimes
occur, allowing for an extended period of five weeks to conclude. If we can get
your order despatched before the approximate lead time we will do so. We cannot
accept any liability or damage claims resulting from delayed deliveries.
When we receive your furniture we will contact you to inform you either via
email or telephone to then arrange a mutually convenient delivery day. Please
note that currently we do not deliver at weekends.
We deliver within a 50 mile radius from the store, however should your delivery
area exceed the 50 mile radius but remains within the UK mainland, you will
need to make your own delivery arrangements.
Should your order become delayed beyond our control, we will make every effort
to keep you informed of any revised delivery schedules. It is important that
you must take delivery of your goods within a reasonable time after they become
It is important that you are responsible for providing adequate access to your
property and the area to which it is to be placed is suitably cleared to enable
delivery of goods in a safe manner. We cannot accept any liability for damage
to property resulting from inadequate or difficult access. We accept no
responsibility for any other damage caused to the property during delivery.
Our delivery team will unwrap your goods (unless self- assembly where an
additional charge would be applied and agreed at the time of order if the goods
are to be built up within your home), goods will be installed into a room of
your choice (when delivered within the 50 mile radius by WFS LTD employees).
Unfortunately within this service we cannot remove and dispose of your old
furniture. Additionally we cannot remove furniture and relocate into
another room or premises.
You must inspect all goods within a reasonable time and report any damage or
shortage of delivery as soon as possible by contacting the branch via phone or
PRODUCTS, COLOURS, FINISHES & DIMENSIONS
Products, Colours, Finishes
& Dimensions: Whilst every effort will be made to match colours and
finishes, all natural and synthetic colours and finishes can only be supplied on
the understanding that there is always a possibility of variation, natural
products are supplied in their finish which may contain knots, grooves and
colour variations. Upholstery fabrics
are not supplied guaranteeing a pattern match. All measurements are given as
approximate. If you intend to use
furniture in a commercial setting it is your responsibility to ensure that the
products purchased meet the standards required for the environment in which
they will be used, should these fail we do not accept any responsibility for
damage or injury caused. Whist we aim to provide information, the consumer must
consider the products appropriate weight tolerances in domestic settings being
'fit for purpose', certain items do have identified weight restrictions.
All items are under the manufacturers guaranteed of one year, as well as your
statutory rights which excludes normal wear and tear and all covering fabrics,
leathers and fillings, this means that should any structural component fail
during normal use and excludes non-domestic use, this will be repaired free of
charge but will exclude if used from within non domestic use, abused from
children, pets or any other source.
Should the furniture exceed the 50 mile radius, it may be suggested that the
defect model is fully replaced rather than repaired. If the goods location
exceed the 50 mile radius it will be your responsibility to return the faulted
item(s) to the store where we will do our utmost to get your replacement goods
out to you in a timely manner. Our Customer Services department will liaise
with you to ensure there are no delays with your replaced goods within our
DAMAGES | EXCHANGES
All furniture items sold on the internet by WFS LTD are made to your order,
specifically aimed at fabric upholstery furniture, sofas and chairs, these
items are not taken from stock and are made to your individual specification
therefore we are unable to offer an exchange for these items. However if they exclude
any made to order goods, and your expression is notified to the store within
three days of taking delivery, we will arrange for you to reselect onto a
another model or the same or higher value. There will be an
administrative and delivery charges applied. Please note the goods must be
unused, from within a domestic environment and received no abuse from children,
pets or any other source and remain with their original packaging, if they fail
to be received in the same condition as initially dispatched an exchange will
no longer be authorised and the administrative and delivery charges will still

It is important that each item
be carefully inspected by you and/or your Authorised Agent immediately upon
delivery. In the event of damage or
defect, please notify the delivery person.
If this can be corrected by the delivery personnel, it will be taken
care of immediately.
At WFS LTD a call-out service
charge will be made should a problem arise when furniture is deemed out of a
manufacturers warranty, within a 50 mile radius of the store and the fault is
due to customer misuse. WFS LTD reserves the right to charge you for
administration time and for the fees of an upholsterer or other expert should
investigations identify the faults are not deemed to be a manufacturing defect.
Should you arrange to have an independent upholsterer report commissioned these
monies will not be reimbursed by WFS Ltd.
All servicing and complaints must be put in writing to the address
detailed below together with a copy of proof of purchase:
Please note goods which have
been manufactured for your order ?made to order,? the normal procedure of
contacting the store must be followed, the consumer must allow WFS Ltd the
opportunity and a reasonable period of time of rectifying the faulted goods
before refusing to accept and requesting a full refund. You may fully expect that we will handle
returns professionally and on a priority basis.
To give your returned item the care and attention it requires, please
allow both our Customer Service and Quality Control Departments adequate time
to evaluate the problem. We are
available to keep you apprised of the status of your order and estimated time

DAMAGE TO YOUR COMPUTER
Where WFS LTD will make every effort to ensure that the website is free from
viruses or defects, however due to the nature of the Internet, we are unable to
guarantee that your use of this website will not affect your computer. It would
be recommend that your purchase the necessary anti-virus and firewall
protection software for your computer which would aid the prevention of any
corruption/ damage to your computer from accessing the website. WFS LTD shall
not be liable in the unlikely event that you incur any damages or loss.
GENERAL DATA PROTECTION REGULATION (GDPR)Your personal information is held and stored when an order or
contact is made concerning a service. We
will never sell or share your information in accordance with the GDPR.

well as the legal basis for the use can be used as follows:
